Terms of service

These Terms of Service apply when you visit opaladobe.com.au or buy products from Opal Abode. “Opal Abode”, “we”, “us” and “our” refer to the online store operated by Choudry Hassan Ashraf Chattha, ABN 16 097 397 828, in Victoria, Australia.

By using the website or placing an order, you agree to these terms. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Using the store

You must use the website lawfully and must not interfere with its security, operation or availability. You must not introduce malicious code, attempt unauthorised access, scrape the website in a way that disrupts its operation, or use store content to infringe another person’s rights.

You are responsible for ensuring that information submitted at checkout is accurate and that you are authorised to use the selected payment method.

Product information

We take reasonable care to present product descriptions, specifications, images, colours, availability and prices accurately. Screen settings, packaging updates and manufacturing variations may cause minor differences that do not affect a product’s essential characteristics.

If we discover a material error in a listing or price after an order is placed, we will contact you. We may offer the option to proceed with corrected information or cancel the affected item and provide a refund. We will not rely on this clause to avoid obligations under the Australian Consumer Law.

Prices and GST

Prices are displayed in Australian dollars (AUD).

The store operator is not currently registered for GST, so no GST is charged as a separate component of the sale price and documents issued by us should not be described as “tax invoices”. If our GST status changes, the website and invoicing information will be updated.

Delivery charges, if any, are shown before checkout is completed.

Orders and acceptance

Submitting an order is an offer to buy the selected products. An automated order acknowledgement confirms that we have received the order; it does not necessarily mean the order has been accepted.

We may decline or cancel an order before fulfilment where reasonably necessary, including because:

  • a product is unavailable;

  • payment is not authorised or is reversed;

  • we reasonably suspect fraud, unauthorised resale or misuse;

  • delivery information is incomplete or outside our service area;

  • a material pricing or listing error occurred; or

  • we cannot lawfully supply the product.

If we cancel an order after payment, we will refund the amount paid for the cancelled item. We may contact you before taking action where appropriate.

Changes and cancellations requested by customers

Contact hassi.ac@gmail.com as soon as possible if you need to change or cancel an order. We will try to assist before fulfilment starts, but changes and cancellations are not guaranteed after processing begins.

We do not currently offer pre-orders, backorders, subscriptions or gift cards.

Payments

Payment methods available for an order are displayed at checkout and may be provided by third parties. A provider may apply its own terms, eligibility checks or privacy practices. We do not control a payment provider’s approval decision.

You authorise the applicable payment provider to charge the total shown at checkout. We may delay fulfilment while payment or fraud checks are completed.

Shipping and delivery

Delivery is governed by our Shipping and Delivery Policy. Delivery windows are estimates unless we expressly agree otherwise. If an order is delayed, missing or damaged, contact us so we can investigate and provide any remedy required by law.

Returns, refunds and exchanges

Our voluntary change-of-mind terms and the process for faulty, damaged or incorrect products are set out in our Returns, Refunds and Exchanges Policy.

Australian Consumer Law rights apply independently of our voluntary policy. Products come with consumer guarantees that cannot be excluded. Depending on the circumstances, a failure to meet a consumer guarantee may entitle you to a repair, replacement, refund or other remedy.

Warranties

We do not provide an additional store warranty unless one is expressly stated on the relevant product page or supplied with the product. Any manufacturer warranty is in addition to, and does not replace, rights under the Australian Consumer Law.

Reviews and other submitted content

If you submit a product review, photo, video or other content, you confirm that:

  • it reflects your honest experience;

  • you have the right to submit it;

  • it does not unlawfully infringe privacy, intellectual-property or other rights; and

  • it is not misleading, abusive, discriminatory, defamatory, obscene or malicious.

You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display the submitted content in connection with Opal Abode and its products. You retain ownership of your content. We may moderate or remove content where reasonably necessary, but we will not edit a review in a way that misrepresents the reviewer’s opinion.

Intellectual property

Unless otherwise stated, the website’s original branding, design, written content, graphics and arrangement are owned by or licensed to us and are protected by applicable law. You may use the website for personal shopping and may save or print reasonable extracts for personal, non-commercial use.

Third-party product names, trade marks, photographs and content remain the property of their respective owners.

Third-party services and links

The website may use or link to third-party services, including Shopify, fulfilment, delivery, payment, review, analytics and social-media services. Those services may have separate terms and privacy policies. A link does not mean we control or endorse all content on the external site.

Liability

To the maximum extent permitted by law, we are not liable for losses that were not reasonably foreseeable, were caused by your misuse of a product or the website, or arose from matters outside our reasonable control.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability and remedies arising under the Australian Consumer Law.

Governing law

These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws. The courts and tribunals of Victoria have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable consumer law.

Changes to these terms

We may update these terms to reflect changes to the store, services or law. The version applying to an order is the version made available when the order is placed, except where a change is required by law.
